The aim of this talk is to provide an argument to establish a systematic connection between hyperintensional contexts, those in which co-intensional expressions cannot be substituted salva veritate, and the possession of a Theory of Mind, the cognitive ability to attribute beliefs to others and one self. More specifically, it will be argued that a hyperintensional context in which at least one of the agents is not exercising her Theory of Mind cannot be found. The thesis that hyperintensionality is a mark of the mental will be confronted with several counterexamples, and some of the possible applications of the thesis will be spelled out.
